Hi, just a general query..I'm living in Australia (now a resident), i'm guarantor on a property in ireland and the owner is now having difficulty paying the mortgage. I'm wondering if the Irish bank can persue me for mortgage payments in Australia?

1. If the bank has your address in Australia or hires a private investigator to obtain your current address, then of course the bank can sue you and pursue you in australia for the money. Essentially, all the bank will do is issue proceedings in Australia on the guarantee and after obtaining judgment, execute it against your assets in Australia. Debt obligations do not stop at National boundaries. Even though you are in australia, it is nowadays a simple matter to locate a person living in the Western world. Any debt obligation, such as money owed on a guarantee, can be sued upon and enforced in Australia.
