Hi, I'd like to ask a question about time limits on land transactions. My father & neighbour swapped plots of land of similar size 20 yrs ago. They both used the same solicitor who died 5 yrs ago.My father died last yr & everything is being divided between the family. It seems my fathers plot was transferred in name to our neighbour but the neighbours plot is still in the neighbours name.Is there anything we can do about this or is it too late as both my father & acting solicitor are dead. The solicitor's firm say there is nothing we can do after 10 yrs.Thanks.
Was your father in full possession of the land since the time of the supposed transfer. i.e. 20 years ago??
No, my fathers plot was transferred in name to the neighbour. But the neighbours' plot was never transferred in name to my father. So only half the transaction was carried out.
Will there be a record of the fact that no money changed hands & that it was an exchange/swap rather than a sale?
I am asking in relation to the land that was supposed to be transferred to your father. Was he jn possession of that land since the supposed transfer. Ie the neighbours land
The land has not been in use since the transfer 20 yrs ago.In fact, neither of the plots have been used.
