Hi, I have been informed that my husband is seeing another woman and we have two young childen. What are my legal rights in the event of a separation?
If you go down the route of judicial separation. The courts paramount concern is that sufficient provision is made for all parties involved in the separation based on the circumstance of the couple. Obviously this differs depending on individual circumstances but in general term they ensure that people have a place to live and if previously supported by a party to the marriage that such support continues.specifically in your circumstances, you would be seeking maintenance for both yourself and the children and possibly to retain the family home until such time as the Children complete full time education
Thank you Ronan, on past experience when my husband and I were having difficulties, and we discussed a separation, he would not leave the family home, he insisted that I leave. A previous complaint made by me to the gardai about him is on file and I fear involving them again.
Ultimately, if it cannot be agreed it will be for the judge and not your husband to decide. He may be force to leave the family home by the court
