WHAT RIGHTS HAS A WOMAN ON HER PARTNER
1. A woman who is unmarried and living with a partner only has rights if she has been living with him for five years, or two years if there have been children of the relationship. If this is the case, then she has three potential rights against her partner. Firstly, a right to maintenance if there are children of the marriage. For example if there are two children of the relationship, she will get 20% of his net after tax income to provide for the children. Secondly, she will have a right to have property adjustment orders made if she is an economically dependent partner. This generally occurs where there is a house and it is needed to provide for the children. Additionally, the assets of the relationship will be divided under this heading. Finally, she will be entitled to a proportionate share in his pension, which will be whatever proporition of the average 40 year working life she has been with him, of half his pension.
