Ok... Lets say a person has dog. This person has a Copyright

Ok... Let's say a person has dog. This person has a Copyright on this dog, a name for the dog, and all imagery of this dog. They have basically branded the dog so-to-speak. The dogs face & name on coffee mugs, t-shirts, etc...

Would I be infringing any laws if I hired an artist to paint, and/or digitally create an original image of this pet (not a direct copy) for use as a character in software? Please bear in mind that the imagery would be unique, and would not be a direct copy of any imagery owned by the owner of said pet. The imagery used would be completely original artwork, and would not be photo-realistic. Additionally... the character, and/or verbiage to be used in the software would not use any copyright names/terms, etc...
