Hi, I am actually a US citizen with a question about my sister who is visiting us here in the states on a visitor visa. She is a citizen of Albania. I want to know how I can keep her here permanently, what forms I need to fill and things like that. Thank you
No, I understand, and i wouldn't rate you poorly because i didnt get the answer i wanted. I do want to make this clear though...you're saying that even though she is here on a valid visitor visa she can not apply for an adjustment of status now but still has to wait the 12 years same as if she was not in the country at all. I mean a visa has become available to her since she is visiting, does that not matter?
A visa has not become available since she as been visiting because she is not an immediate relative of a US citizen. Only parents, children under age 21, and spouses of US citizens are considered immediate relatives of US citizens, and therefore are eligible for an immediately available immigrant visa or green card.
It doesn't matter whether she is inside the US or outside the US, a green card is only available when the government makes it available, and that will happen when her turn in line comes current, and that will not be for a very long time - currently, that wait time is 12 years and 1 month.
