My l1b and i94 expires on August 11 2013. My employer has filed for extension today. Are there scenarios where requests get rejected outright without even rfe.

How long is the current extension processing time?

Hello,my name is Judith. Thank you for this opportunity to answer your questions.

Was the petition filed regular or premium processing?

Customer: replied 3 years ago.

Hi Judith,

Its regular.

Generally the only time a H1B petition gets sent back is if the wrong fee accompanies it or if there is no LCA.

Current processing times are 2-3 months for an extension,

You may continue to work with the pending extension request.

You may continue to work while the L1B is pending.

The L1B is generally rejected as long as the correct fee is attached.

Customer: replied 3 years ago.

So does that mean it will take around 2-3 months for processing L1B extension?

2 scenarios:

1. If there is no rfe what is the general time taken?

2. If there is rfe

3. How are the prospects of L1B extension now.

If there are no RFE it will take 2-3 months.
An RFE usually goes out in the same period of time and then the employer has 30 days to respond.
This can push adjudication time to near 6 months.
I cannot speculate on your L1B. The USCIS reviews carefully to be sure that your speciaqlaized knowledge is proprietary to the employer.
