Can someone be sponsored to work for a business even though the person has been in the US illegally?
Hello,my name is Judith. Thank you for this opportunity to answer your questions.
The employer can file a petition for them if they qualify under the petition category but the worker has to leave the US and get a visa stamp at the US Embassy in their home country.
If they have accrued more than 180 days of unlawful presence they will be denied the visa and cannot come back to the US.

They have to have at least a bachelor degree and the position needs the skill and expertise of at least a bachelor degree.

However, if they have already stayed longer than the 180 days the only way they can get legal is through marriage to a US citizen for love.
