Hi, I am currently in OPT STEM extension which is valid till March 1 2013, I was unable to file h1b in this years cap, am I elgible to file H1b in next year cap in PP at that time I will be in 60 day grace period, also can i travel outside US now will I face any issue at POE while coming back, I still have OPT STEM extension which is valid till next year March visa is also valid till next year Aug.

Hello,my name is Judith. Thank you for this opportunity to answer your questions.You can travel while on the STEM ext with the valid visa stamp. You need to carry with you evidence of our employment such as your payroll history to show you did not fall out of status based on unemployment.You can have an H1B petition filed for you during your 60 day grace period. However, since your OPT EAD will have expired you get the benefit of the cap gap and being able to remain in the US but you will not be able to work until Oct. 1st.Judith
