I was aressted and finger printed for selling and possesing a controlled substance in a store where i work.This is my first offense.I took a pre-trail diversion programm and sucessfully completed and case was dismissed. Now can i travell out of the country and come back, will there be a problem at port of entry when coming back.venkat.

my attorney made a deal with the stste attorney but in the deal i have to admit guilt. the case not yet dismissed . Will be dismissed in couple of weaks.
I have bad news for you.Under the immnigration laws if there is an admission of guilt it counts as a conviction regardless if the case is dismissed.I would definitely not travel outside the country.Judith

what about after the records are expunged or sealed.
That only means that your record is not available to the public or an employer. Law enforcement always has your arrest record available to them and when you pass through customs you will be flagged b/c that will be known to the officer when your passport is scanned.Judith
This Pre-Trail Diversion programm is between the two Attroneys it does not go to the court. How the Immigration will no about the admission of guilt at the port of entry.
Then this is not a conviction. This makes a difference, that is why I asked the question about appearing before a judge and admitting guilt.
If you travel you need to carry your agreement w/ you.

Can the Immigration at the Port of Entry will be able to see the pretrail driversion contract made between me and the state attorney .The agreement was submitted to the department of corrections to the probation officer.
