I have received a Permanent Resident status in Dec 2011, sponsored by my current employer--who had filed the application under EB1 category (Exec/ Manager). I have been with this company for 8 years. My spouse who has filed for her I-485 Adjustment of Status as my dependent, has received an RFE asking for a copy of her official birth certificate, and she has responded to it, and her case is still in process. I have received a new job offer, starting March 2012, in a similar role with another company. I do not have any contract with my current employer which prevents me from resigning from my current job to join another company. My question is (a) Is there a "wait period" before I can change employers after getting my green card? (b) If I change employers, is there a risk to my spouse's I485 application, which is currently under processing?
(a) There is no formal "wait period" written into law or into the regulation for you to change employers after receiving your green card. A general rule of thumb or unwriiten rule is that a person should wait at least 90 days because the time period in which a person leaves the employer who sponsored his or her green card occasionally emerges under the "good moral character" prong of United State citzenship if it appears that person only used the company to sponsor his or her green card but had no intention on continued employment with the company.
(b) The fact that you changed employers would not have any legal effect as to your wife's green card process.
