i just got a date for a removal procedure. I am married now and would like to file for my and Green Card. My lawyer thinks it wont work because i have been married before and my ex hubby and i got divorced before the immigration process was done. I am currently pregnant and i feel overwhelmed. Any advice. Is it possible to ask for the more time until i've had my baby to go back to court?

Thank you for your question.Your husband may apply for an Application for Waiver of Grounds of Excludability on your behalf (I-601)In order to prevail, extreme hardship to your husband as a United States citizen will need to be shown. Approval also requires a favorable exercise of discretion from the Attorney General. This requires a weighing of all factors, the favorable against the unfavorable, in each case.I suggest that you retain local Immigration counsel to assist you in this application.

I have sought an attourney. Like i said, she doesn't think they will grant me cos i have been married before and didn't finish the process before i got divorced. Also, you didn't answer my question about asking for more time so i can have my baby to continue going to court. Is this possible?
