I am US citizen. I would like to file I-130 petition for my parents (who are currently in India) to get them permanent residence in United states. I have my maternal uncle in US and he is also US citizen, He has already file I-130 petition file for my mother in 1999. Now my question is can I file I -130 petition file for my father and my mother can also come as dependent with him? or We have first do something for the petition file which my maternal uncle has already filed ?.....In general can we keep two petition file i) from my maternal uncle for my mother and ii) from me for my father & mother
They can both be on file. You can go ahead and file for your parents. There is no prohibition to qualifying under different categories with different sponsors.
