existing double hung windows are currently 17 inches off the floor, when replacing them,do both sashes have to have tempered glass. this property is in new hampshire.

Any glass within 18" of the floor must be tempered. If the upper sash can be lowered to that point then it too must be tempered glass. BTW it's the glass itself that's less than 18" off the floor not the window.
