A cashiers check to Zeekler, not cashed.

 

Customer Question

I sent a cashier's check to Zeekler, which is announced as ponzi by SEC today, and frozen all the activities and acounts. http://www.sec.gov/news/digest/2012/dig081712.htm When I asked the status of the check to my bank, I was told it's still not cashed yet. According to SEC, the owner of Zeekler accepted his busines is a ponzi and agreed to pay penalty. In this situation, can I stop my cashier's check from cashing, since it's not cashed yet, but sent to an illegal company? Thank you!!

Hi Jacustomer,

I'm sorry to have to be the one to tell you, but under ordinary circumstances such as yours you can not put a stop on a cashier's check. The very purpose of a cashier's check to begin with is that it is considered as good as cash -- it is guaranteed to be honored and under the Uniform Commercial Code your bank is obligated to pay it. The exception would be if your check somehow were lost or stolen, (see UCC 3-312) but, of course, that is not the situation in which you find yourself in.

Currently all the asset of Rex Venture is frozen, and no individual


can cash my check with the name of "Rex Venture".


What are the possible future actions expected on my check?


Do you think it's up to the recipient designated by SEC mentioned


in the article link in my first question?

Hi Olivia,

You ought to keep checking on that. Presently the account is frozen, but monies can still be deposited into a frozen account, just not with drawn. If it just seems to hang in limbo, you may actually be able to stop it at that point. But since the government has done this to equitably pay those defrauded, it's likely that they will want and use this.
