what you at experiencing is cased by low battery voltage, this causes the contacts in the starter to heat up and actually weld together, to repair you need to replace the starter and both batteries, and I would suggest you have the charging system checked.

the starter is not stuck now do you think i still need to repace it

you can try it with new batteries, but usually when the contacts in the solenoid stick, they will do it again.
