can a level 3 sex offender be in posesion of any type of firearm i.e b b gun ect.

Ok...a convicted felon can never be in possession of a firearm. It is a violation of federal law, and I'm sure your state laws as well. Now, a bb gun is generally not considered to be a firearm. A firearm is usually defined as a device that fires a projectile by the action of an explosion of a combustible material. A bb gun fires a projectile by use of compressed air which is not a combustible material. None of this should be considered as legal advice and there maybe some state laws in your state that may include a bb gun in that classification. I would highly suggest that you check with an attorney for a legal determination.
