Hi, I drive a semi truck for a private carrier and would like to know if there is a federal law which prohibits truck drivers from carrying a firearm? I do have a CHL also.
Already Tried: Trying to research on net but as usual lots of conflicting info on this
Hello and thank you for coming to Just Answer. We appreciate the opportunity to help you with your firearms question. There isn't a federal law that prohibits truck drivers from carrying firearms, but if you enter any areas that are controlled by the federal government (national parks, national monuments, or similar areas), there are federal laws that govern any person carrying a firearm. A rule passed in 2010 allows the carrying of loaded firearms in national parks. Previously to that law, a person could carry an unloaded firearm in a national park, but not a loaded one. The law allowing loaded weapons in national parks could be overturned at any time if federal legislators that believe in banning guns become the majority in both houses of Congress again.
The problem that you are going to find as a truck driver with a concealed carry license is that there is no standardization of firearm laws between the different states. Each state that you drive through will have different firearms laws. You didn't mention what state you reside in, but in my home state, the county sheriffs issue concealed carry permits. If you contact whatever state or county authority (the sheriff's office if your state is like mine) issues concealed carry licenses in your home state, they should be able to give you a list of states that will recognize your concealed carry license and grant you that same rights that you have in your home state. If you travel into states that aren't on that list while carrying a concealed weapon, you are at the mercy of that state's laws and they won't recognize your concealed carry license from your home state. If you are going to carry a firearm while driving your semi through multiple states, you need to research the rules of each state that you will pass through, if they aren't on the list of states that recognize and allow your home state's license.
Tourists from Texas with valid concealed carry permits from Texas have been arrested in New York state for carrying firearms, so carrying a firearm from state to state can have substantial risks. The National Rifle Association and many sporting goods stores carry copies of a paperback book on the firearms laws of the fifty states for travelers, designed specifically for people that travel and would like to carry their weapons between multiple states.
Also, keep in mind that you are not allowed to carry concealed weapons into federal buildings in any state and that most states also have rules banning normally-legal concealed weapons from schools and public buildings like courthouses. You need to be careful where you carry your weapon, even when you aren't in your truck.
