Has your husband threatened abuse or has he physically abused you?

he threw a chair at me a month ago. other than that, no

Ok. IF you could charge him with assault/domestic violence, then you could seek a restraining order through criminal court and keep him away. But, if there's no harassment or threat of harm, you'd likely have to sue for a divorce and seek a restraining order through the family court.
