Does a domestic partnership entered in 2004 in New Jersey

Customer Question

Does a domestic partnership entered in 2004 in New Jersey automatically convert to a marriage? Now that it is legal for same sex marriage. We are now both over 62. Social security says that that we are not entitled to survivors benefits unless we get married.

Civil unions or domestic partnerships do not automatically convert to marriages. A civil union/domestic partnership couple will have to apply for and receive a marriage license and thereafter engage in a marriage ceremony in order to receive a marriage certificate.
