If you are asking whether your case could be thrown out because you believe you had an incompetent, do-nothing lawyer, the answer is no. On the other hand, if you go all the way to trial with your new lawyer and you lose the case because of problems caused by your old lawyer that cannot be undone, the ineffective assistance of your first lawyer could be the basis for an appeal and a possible reversal of your conviction.

You could file a grievance with your lawyer's bar association, and they will investigate. You could appeal your case on the basis of ineffective assistance. You could also consult with a civil attorney and go after your lawyer for malpractice, but that's most successful when there's a finding someplace that he or she was ineffective.
