QUESTION: With no custody legal, residential or otherwise and with an informal
agreement of prior visitation by father, can mother move to another state other
than the state child resides in without approval?

Thank you for using JustAnswer. I am Loren, a licensed attorney, and I will do whatever I can to answer your question.
As a general rule, without a custody order entered by a court or a pending custody petition, either legal parent may move anywhere in the country without the consent of the other.
The only caveat is that if you do it with the intent of keeping the other parent from having contact it can be considered parental kidnapping, but as long as the other parent knows how to find you and the child and is not kept from visiting then such a move is not illegal.
