Dear Customer: Thank you for this question. It is totally normal and understandable that you are anxious about court. A Judge will consider the best interest of the children. This means that a judge will take into account the parenting skills, emotional support and safe environment being offered by both parents, and will make orders in favor of whatever is best for the children. The substantial criminal history of the father is going to work heavily against him in any hearing effecting the children. Also, the fact that you have offered to really work with the father will certainly aid you in getting the relief you are seeking during this hearing. The miniscule amount of time the father has been spending with the children will also work against him significantly. Certainly, him not paying child support is frowned upon by judges. Sometimes, it is in the best interest of the children to move where the new stable environment can be provided. This new chapter in life sounds like it is in the best interest of the children, and I believe that given what you have said here, that a judge will agree. I would be happy to follow up with more help and legal support for you, should you send along anything further in this chat.
