If my daughters father (whom I never married) had a 50/50 custodial

This answer was rated:

If my daughters father (whom I never married) had a 50/50 custodial agreement, do I retain full custody as a default since he passed away?

Steven Kincaid :

Thank you for allowing me to assist you.

Steven Kincaid :

Yes. Upon the death of a parent, the other parent automatically has complete custody over that child, unless and until a judge orders a third party to have custody. Of course, that does not usually happen, but it can, if the court determines that parental custody would be detrimental to the child.
