A child does not have a legal right to decline to comply with a court order of visitation. That said, you may petition the court for modification to the visitation agreement based upon the child's preference. A Texas court must consider the child's preferences once the child reaches the age of 12.

Age is not the only factor that is considered by the court. Typically, the court will take into consideration the maturity of the child and the child's reasons for requesting the change.

What if this visitation ruling is effecting the child emotionally?

The emotional effect on the child would be a substantial change in circumstances warranting a modification hearing. At the modification hearing the court must consider the child's desire to stop visitation
