my childrens father never paid child support up until the past

my childrens father never paid child support up until the past year my daughter is 20 and attends college lives at home with me and my son 15 also lives with me attends a private school..which he refuses to help me with because he said that was my decision, both children have always been on my health insurance. he gives me 450 a month, is it possible to go back and make him pay back support for both kids or no because she is 20 even though he never paid support. I pay 237.24 a month just kids in health not including dental 24.72 a month kids only.

Hi again.

Since there is no court order, I'm afraid that you cannot require him to pay back child support. You can get a court order now for child support, and make the father pay for your 15 year old child for the next few years. But if he's already voluntarily paying $450 per month, you may want to just stick with that to avoid having to go to court, pay attorney's fees (if you intend to retain an attorney, which I suggest), and because depending on his income, the amount that you get from him may not be much more than $450 anyway since there is not just one child who will likely qualify for child support (I'll point out that it's possible that the judge will order child support for your oldest). In any event, I'm sorry to say that the award would not be retroactive.

well I truly appreciate you answering my question I'm not mad about it just want things to be fair between "parents" and if that's a fair amount then I'm fine, I was never "out to get him" and I can't afford to go to a lawyer but did want legal advice and you did a good job. thank you
