I assume that there is a mortgage on the property. Can he refinance in his name only? If so could he refinance for enough to buy you out?

no he has a chapter 13 that he is paying on I just want to have a legal form that states after he has paid me 25000 i will sign a quick claim deed i only want 400 dollar a month payments so it will take him years to pay me off

Since you are on the mortgage you need to realize that you will be responsible if he quits paying. Further you will not be able to get a mortgage of your own on another place.

What you are wanting is a contract for the sale of real estate. I would strongly urge you to have it drafted by a local attorney. Here is a referral site.
