Should I include the new evidence in my summation affidavit?

Resolved Question:

Should I include the new evidence in my summation affidavit? As I said before there will not be an appearance, I was informed I had to submit my summation writ by mail or just drop by leave it at the Court in person. Is that correct and legal?

It's correct that some courts do it that way ... its up to the judge.

Go ahead and include the new evidence ... it wouldn't hurt your situation. I do have my doubts as to whether the judge will accept it. (But maybe that's just me.) As I said, it can't hurt.
