My husband owes child support for a child who is now 40 years old. His social security disability checks are currently being garnished. His former spouse lives in California, and we are in Arizona, If we purchase a home in Arizona, can his former spouse place a levy against the house?
Optional Information: State/Country relating to question: Arizona Already Tried: We have not purchased the house yet.
Is there a judgment against him for the owed child support?
Hello how are you today?
My husband thinks that there is.
Ok, in California?
Yes.
Ok, the answer to your question is that the spouse would have to rerecord the judgment there in Arizona in order to place a lien against the purchased home. Additionally, the lien for the judgment would not be executed until and if you sold the home there in Arizona, if she in fact did record it in Arizona.
