I am a single mom with two children who have been: daughter molested/fondled, son threatened/harmed, by their father. He has also done the same to my two older children in the past, which is why we are divorced. I have a hearing set August 7th 2012, need answers/representation for my children.

The County is Churchill, Fallon, NV. My two children are now 18 & 25. These are the two who were molested & beat by my ex from 1995-1999. My daughter who is now 25 told me what was going on & I witnessed some of the abuse which prompted me to take all 4 of my children & seek shelter in a safe house. Law Enforcement in WY, which is where we lived at the time, interviewed my daughter but refused to testify because my ex told her he would kill her & her siblings as well as me. The report was filed & testimony was only from me on what I witnessed. My attorney & members of the Safe House supported me & the judge granted my divorce & we left the state. Complying with the order with regarding visitation it wasn't until my youngest daughter began attacking me at age five until finally getting her into a mental health facility that I learned that her father had been molesting her every time she went to visit him in the summers. She was angry at me because I made her go. Now he is trying to take her & her brother back to Oklahoma after Dept. Of Human Services in OK determined that after their investigation he could keep the children in McAlester, OK but only with them living in a Foster Home & allowed to have Supervised Visitation 'once' a month or send them back to NV to live with their mother. So they flew back to NV in August 2010 & have been here since. I need to know how to obtain the report from DHS for court how do I do this, what form subpeona or order & do I need an attorney for my two children?
HiI am sorry to hear of all these situations. If you have a pending matter, you can go to the clerk of the court where it is pending and reques a Subpoena for the documents. Explain what it is for and who it is to and they will prepare it for you. If you do not have a pending matter, you cannot get a subpoena. It may be best to request a Guardian Ad Litem via the court to represent your children's best interest.Also, you may want to consult with an assistant District Attorney in your county and let them know what is going on.
