Will the fact that my husband is having an affair and plans on continuing to do so, affect child custody?
Optional Information: State/Country relating to question: North Carolina
Hello,
Thanks for your question.
The only way an extramarital affair would really have a bearing on child custody is if it somehow affects the best interests of the child, which is the standard used by courts in determining custody and visitation issues. An adulterous relationship could indicate to the court that this person is not a very stable, responsible person, or that he/she does not put the needs of the child first, which are factors to be considered with respect to custody and visitation.
Hope this helps.
