MY WIFE AND I HAVE DECEIDED TO DIVORSE BEFORE LEAVING I BROKE ONE OF MY CELLPHONES, I BOUGHT A NEW ONE AND GAVE IT TO HER SHE SAYS I HAVE TO REPLACE THE ONE I BROKE WITH THE SAME TYPE IS THIS TRUE?
Optional Information: State/Country relating to question: Massachusetts Already Tried: NOTHING
No, it is not true and she is making things up as she goes along. There is no basis in law for this. As long as the phone was comparable to the one that was broken that is all you had to do. If the phone belonged to you, then you could replace it with whatever type of phone you wanted to replace it with. If she wants to argue this, she can ask for the difference in price as part of the marital property settlement, but the court would find her pretty petty and would not likely be kind to her about it.
