I suggest you try the SC Bar Association for a referral service. The Referral Service will be able to put you in touch with a SC attorney who is also licensed in California. I will get you that contact information
may I ask another question?
You can call(NNN) NNN-NNNN In Richland and Lexington counties, call(NNN) NNN-NNNN
You may ask
Am I entitled to ask for my ex husbands W2's every year or so to see what he has been making?
When we first divorced the settlement was for $2600 per month alimony...
You can only request them if you have a pending matter
So if you are seeking to modify the support, then you can subpoena his W2s. I believe that is every 2 years
Then last year (4 1/2 years into the agreement) he lost his job and had a cut in pay of about %15 .... the judge cut my alimony to $1675. I didn't feel it was fair
that you can file for the modification in California
You will need to wait to file the modification. I am sorry your support was cut
well the original agreement was to set to end in the year 2020... even though we were married for over 25 years... I want to take him back to court to get the settlement extended for life... what are my chances?
Every thing is evaluated on a case by case basis, you see
If you can show that you will have a need for lifetime support, then it may be granted
that is what is going to be required.
well I am disabled now.... and have only SS
Alimony is based on need and ability to pay
So if you are disabled and can show you will need it for your life, then you should certainly request such a modification.
oh ok.... and if he is able to pay I may have a case?
I have a mental disorder and that was one of the reasons he filed for divorce
ok. that makes me f eel better
Good. Yes, you have a chance. But you will need to wait to file.
Samuel I really appreciate your help..... how long will I need to wait?
If it was just modified, you need to wait the 2 years
ok... so about 2014 at least
I mean you can file it now. Though if you consult with a local attorney they will tell you no sense in filing now
because it could be dismissed. Well, that's what you should be told anyway
I see. I must be patient... it is just so hard... he left me for my best friend. That really bothers me so much... and I just found out they got married about a year ago
divorce is so cruel.
oh well... I thank you for your time
Yes. It is never pleasant
please be well.... and have a good evening...
Thank you. You too.
