You dont want to do that without consent of both parents or a court order. Otherwise doing so may be used against you by the other parent, who may seek return, or use it for arguing for custody.

what would I need for a court order

You would need to file for the divorce, through a lawyer, and seek in the interim for certain relief such as custody and leave to go out of state with the child. This would be handled by petition to the court for such relief.
