Resolved Question:

Hello there:

You would first have to serve the parents and, depending on the age of the child, possibly the child as well. The court is not responsible for serving the petition; the petitioner is. The parents are given a chance to respond to the petition. The court hears all sides and makes an order with parameters designed to serve the best interests of the child.
