Can two women (lesbian partners) be listed on a birth certificate

Resolved Question:

Can two women (lesbian partners) be listed on a birth certificate in California?

Thank you for contacting with your question. I will provide legal information related to your question.

At this time CA is not one of the states that allows two women to be named as parents on the birth certificate. Maryland and New Jersey do at this time.

What will happen if we place both of our names on the birth certificate?

The current birth certificate forms says Mother/Parent and Father/Parent.

If no one catches it, then it will be filed and you will both be listed as the parents. The state may later try to remove one of you if the error is found and that will cause you to have to litigate the issue.

If it is noticed right away, they will not accept it or file it until you submit it with only one female name.
