If my decree says that spousal maintenance, shall be reviewed

Resolved Question:

If my decree says that spousal maintenance, "shall be reviewed de novo" by a certain date, and if my wife does not seek review and that date passes, is it over?

Thank you for your question.

That is subject to interpretation. That the order states that it shall be reviewed by a certain date seems to mean that failure to do so would preclude any further review beyond that date. However, the court may interpret it that the review should occur by that date but can occur later if necessary.

I'm sorry, but there is just no clear answer because it is subject to the court's interpretation of the language of the order.
