My husband and I have been married 3 years. Four months after

Resolved Question:

My husband and I have been married 3 years. Four months after our marriage he started using drugs. I found out then that he had been addicted to them before we married. I have helped him get help several times but with no success. Can I file for an annulment?

Hello,

Thank you for your question.

Your remedy is to obtain a divorce as you would not qualify for an annulment.

Grounds for annulment are bigamy, legally incapacity to marry based upon age or mental illness, intent to defraud some other person, business, or government agency or failure to consummate the marriage.

Thus you will need to file for divorce
