Can a 16 year old minor leave home without Parental Consent in Florida? If not, at what age can she leave?
Optional Information: State/Country relating to question: Florida Already Tried: Nothing. This is my son's girlfriend and we live in Texas where her mother is. Her father lives in Florida where she is now, but both of her parents abuse drugs and only care about using her as a pawn between them as they have both remarried and have other children with their current spouses. In fact, she was sexuallly abused by her older step-brother when she was only nine and threatened with being kicked out by her father if she didn't retract her story. Please HELP!
No, she cannot leave without consent of the Custodial Parent until she is 18. However, based upon the circumstances the mother could file a motion to change/modify custody and the minor is of sufficient age, in addition to the circumstances if proved, that she could testify as to her wishes and the court may consider those wishes as one of the factors in determining what is in the best interests of the child.
