Hi. I sent my daughter to live with my parents for safekeeping until I established a restraining order against her father. They have since reneged on returning her and I'm still her custodial parent. They keep putting conditions on me having her and won't even let me see her. They live in Florida and I want to know what I can do to go get her back
Optional Information: State/Country relating to question: Florida Already Tried: I have told my parents I'm dissolving power of attorney and am going to get her at the end of the school year and they refuse to work out anything with me. They are essentially blocking me from her with bullying and threats. I want to know if I can just go get her from school and return to Colorado.
Yes you can go and get her with our without a custody order. She is your daughter and they cannot keep her unless they go to court and get a court order. The power of attorney does not override your rights to custody. You can go get her from school and return to Colorado.
