hello, my question is.. i share custody of my 9yr old girl with my ex. they live in colorado and i in texas. i found her new husband listed as a convicted sex offender. he was a jailer and slept with an inmate. this happened 3 years ago before they married but were living together. is this info enough for me to file for sole custody and in which state? we were divorced in colorado. thanks i look forward to a reply, anthony

Courts are loathe to place children in unsafe homes. If the mother married a sex offender, that should weigh heavily in your favor if you seek custody of your child. Further, the court may be willing to restrict visitation as a result of this other individual's presence, as the individual's sex offender status may place the child at risk.You would have to seek custody in Colorado, as your child resides there.
