I live in New York state and have been divorced about 5 years. I seem to remember my lawyer telling me that if my ex-wife cohabitates for 60 days with a man it would negate my maintenance obligation. Is this true?

This is my first attempt to do anything. I know she moved in with this fellow Sept. 1. We divorced using collaborative law. We both had lawyers. This seems pretty cut and dry if I'm right about the law.

Maintenance ends when the spouse receiving the maintenance remarries, you would have to bring this up with the court to consider, but the statute just refers to losing maintenance when the ex spouse remarries.Thank you for allowing me to help you with your question.
