I want to take over the homeplace but can I get in trouble going there because at that time he lived there and the address for the injuction was that where the home is at? I do not know where he lives. I just no the state and county,place of work.
The injunction is usually against the person not the property. However, if the injunction specifically provides that you cannot enter said premises, then you will need to file a modification of the injunction to permit entry upon that location. Since you know place of work, any court forms can be sent there.If a person has shared custody of 3 children in florida , can the custodian parent move out of state with out notifying the non-custodian parent or the courts. If the non-custodian parent does not want his children out of the state because if they move 14 hours away he will never see them ," can the courts separate these children from the other parent "? The visitation of getting them in summers or holidays would be out of the question andnot an option due to finances,cannot afford summer visit
Per Florida statute 61.13, custodial parent
should not relocate to another state without notification to the other parent and without consent by the other parent or court approval for relocation. Failure to comply can result in the custodial parent being in contempt of court. It can also be used against the parent in an attempt to change custody to the other parent. It is best and safe to get court approval. Relocation is permitted if it will serve the child's best interests, not merely because of better job opportunities, although this certainly is a factor to consider. Most importantly is the abiltiy for the other parent to continue contact, so if that will be an impossibility then that can affect the Judge's decision in granting such an order.
