If my step-mother and father legally separated over 20 years

Resolved Question:

If my step-mother and father legally separated over 20 years ago, is she entitled to property distribution of aires property?

They never divorced correct - only separated?

 

Was anything ever filed - ie. divorce papers?

They were never legally divorced. My understanding is that in the State of Louisiana @ one time Legal Separation was legal. He passed away six years ago.

As far as I know divorce papers were never filed.

Yes, Louisiana no longer has an action for legal separation, effective Jan. 1,1991. However, if there was a Judgment of Separation that was secured prior to the 1991 law then it's still effective. Your going to have to go look up and see if there was a Judgment of Separation on the record books at the courthouse - and then go from there.
