My sons ex wife has just died and he had joint custody

Resolved Question:

My sons ex wife has just died and he had joint custody of their daughter. The deceased ex wifes parents are giving him a hard time with the grandchild possibly seeking joint custody of her. We are in Westchester NY

Since your son has joint custody he now has sole custody. If the grandparents are seeking custody they are fighting a losing battle. In NY they have a statutory right to seek visitation since their daughter died but they will not get custody. This will just be a inconvinence for your son to have to fight this but he should win the custody issue without any problem.
