Customer Question

My wife died on August 15, 2016. She had several individual accounts with US Bank.
JA: Estate laws vary by state. What state are you in?
Customer: She did not work for the last 20 years, so I don't know how she had better credit than me. US Bank sent me a letter saying they would like to be paid. I had previously sent them a certified copy of her death certificate. They say in the letter: "Please note: If no Estate exists, please submit a notarized letter of insolvency on behalf of the decedent." So I am looking up how to write one of these letters. We live in California.
JA: What documents or supporting evidence do you have?
Customer: Like what kind of documents?
JA: Anything else you want the lawyer to know before I connect you?
Customer: Not that I am aware of. Do I need to be connected with the lawyer?

Hello and welcome! My name is ***** ***** I am a licensed attorney who will try my very best to help with your situation or get you to someone who can. There may be a slight delay in my responses as I research statutes or ordinances and type out an answer or reply, but rest assured, I am working on your question.

.

First let me say I am very sorry for your loss, please accept my condolences as I try to help with any questions you have..

.

Are you saying that wife had several accounts that had balances that she owes the bank on?

.

Did she have any assets in her name only when she passed?

.

Were you planning on filing a probate case to settle her estate or does she owe more debts than she has in assets?

.

.

thanks
