Hello and welcome! My name is ***** ***** I am a licensed attorney who will try my very best to help with your situation or get you to someone who can. There may be a slight delay in my responses as I research statutes or ordinances and type out an answer or reply, but rest assured, I am working on your question.

Assets like insurance policies, 401Ks, IRAs and pension plans have their own specifically designated beneficiaries and that controls who receives the proceeds from them. They are only included and covered by the will if the testator named their estate as the beneficiary on any of them.

So if they have named beneficiaries, those assets go to those people directly outside of probate.
