My wife and I retired to France 12 years ago and made wills

Customer Question

my wife and I retired to France 12 years ago and made wills in that country. Family business made it necessary to return to Florida, where we bought a house. Are our French wills still valid? or do we need to re-make them? Also we would like to include a proviso that the last surviving partner can leave certain bequests, that are unchangeable. Is this also possible? Alan Smith

the wills are valid for property and assets in france. You want to have new wills covering assets in florida executed in florida.

you can have the priviso included too. You may also consider having a trust which keeps it out of probate and entrusts trustee to carry out specific bequests, etc.
