can an estate attorney order an audit from a daughter that handled parents fiances for 2 years and had both power of attorneys ? he just took over power of attorney after other sibling got the father to sign over estate. there have been no mis handling of the estate by the daughter, who just wants to walk away from this.

Any audit would have to be ordered by the probate court.Any heir can write the judge asking for such an audit.The lawyer for the estate does not have legal authority over the POA as it predates the estate.The judge can order such an accounting and force the POA to comply or sanction them if issues are raised because the estate may be due funds form this person for misspending.Probate judge has authority to set a hearing on this issue if an heir requests it under Virginia law.
