Request a certified copy of the decedent's death certificate. A copy may be requested through the California Department of Public Health.

what is the size of the estate roughly?
You will need to affirm that the value of the estate is less than $100,000 in order to use a small estate affidavit. Both real and personal property are included in the value of the estate as well as insurance policies and the value of retirement plans.
I have a death certificate. Her estate is about $80,000. With medical bills totalling $500,000.
You would submit a small estate affidavit to get those assets

Do I need a power of atty?
There no need for that
power of attorney only valid when one is alive
terminates on death
